With the help of witnesses, Smyrna Police tracked down a suspect and recovered the stolen items after a buglary at a construction site last week.

Officers responded to the burglary report at the new Simon’s Corner shopping center on Route 13 May 19 at about 7:30 a.m.

After talking with the site foreman, police found that a storage container had been broken into and several items had been taken including a generator, compressor, and tools.

Police interviewed witnesses and discovered that a man was seen at the container and driving away in a truck on May 18 at about 5:15 p.m. Police ran a registration check through the state system and put together a photo line up which contained a picture of the man that the truck was registered to, and he was positively identified by a witness.

After an arrest warrant was obtained, officers went to the man’s home and took him into custody at which time he revealed the location of the stolen items. The items were all recovered and returned to the owner.

Raymond A. Toto III, 38, of Faulkland Heights, Wilmington, was charged with third-degree burglary and theft over $1,000, police said.

Toto was taken to the Smyrna Police Department where he was processed and presented at Justice of the Peace Court 2 by videophone. He was released on a $2,000 unsecured bond to await another court appearance.
