  • Man charged with 5th DUI offense after Smyrna road road incident

  • Smyrna Police responded to the area of Maple Street Jan. 19 at 4:47 p.m. in reference to a report of a road rage incident.
    Police located the two vehicles and stopped the one that was attempting to leave the scene. Police said after making contact with the driver, the officer determined that the driver was under the influence of alcohol and transported him to the Smyrna Police Department for further testing. Brian Rebarchak, 41, of New Castle, was charged with felony driving under the influence of alcohol 5th offense.
    Rebarchak was presented at Justice of the Peace Court No. 7 via videophone and committed to the James T. Vaughn Correctional Center in default of a $2,000 secured bond.
