Delaware State Police arrested a 22-year-old Smyrna man Aug. 13 for allegedly having sex with a 13-year-old girl on multiple occasions.
The alleged incidents took place earlier this year at a residence in Kenton.
Patrick Gassaway, of West North Street, was charged with three counts of second-degree rape, continuous sexual abuse of a child, three counts of second-degree unlawful sexual contact, three counts of endangering the welfare of a child, and three counts of first-degree indecent exposure.
Gassaway lived near the victim when the alleged incidents took place but now lives in Smyrna.
According to court documents, police were called when the victim was seen jumping out of Gassaway's bedroom window; the victim's mother called the police upon hearing the news.
The police report states the victim told police she began having sexual relations with Gassaway in January 2013 and they had sex three times. The victim told police she would sneak out of her house to go to Gassaway's house and she would enter through the front door. She jumped out of his window the last time because her mother entered his residence looking for her, documents said. Court documents state the victim told police the sex was consensual.
Gassaway was also charged with disorderly conduct and two counts of menacing for an alleged incident that occurred with a neighbor who called police when the victim was seen climbing out of Gassaway's room, according to the police report.
He was arraigned at Justice of the Peace Court 2. He was committed to James T. Vaughn Correctional Center in default of $23,000 unsecured bond.
