  • Clayton man arrested on sixth DUI offense, other charges

  • A Clayton man as charged with his sixth DUI offense Saturday afternoon.
    Delaware State Police troopers were called Saturday afternoon at 12:42 p.m. to a residence on Hemlock Way in the Holly Hill Estates mobile home park south of Smyrna in reference to an alleged intoxicated disorderly person, identified as Thomas Kelly, 59. Police said as a responding trooper entered the mobile home park, he spotted Kelly leaving in a 2001 Chevrolet Venture. The trooper pulled in front of the Venture in order to get it to stop and contacted Kelly.
    Police said Kelly initially turned off the vehicle and was cooperative; however, as he talked to the trooper Kelly allegedly started the vehicle and began to shift the transmission into drive. The trooper reached into the vehicle to turn it off and engaged in a brief struggle with Kelly, who tried to stop the trooper, police said.
    Kelly was transported to Troop 9. A search incident to arrest resulted in the discovery of a small glass pipe with crack cocaine reside in Kelly's sock, police said.
    Police said Kelly was charged with his sixth offense DUI, offensive touching of a law enforcement officer, possession of drug paraphernalia, and failure to have insurance identification in possession.
    Kelly was committed to the James T. Vaughn Correctional Center on $7,601 secured bail.
