A Clayton man was arrested Tuesday on burglary charges after he was seen allegedly breaking into a garage on Clayton Avenue.

On Tuesday at 12:20 p.m. officers from the Clayton Police Department responded to the area of 200 Clayton Ave. in Clayton for a report of a burglary in progress. Upon arriving at the residence, police said officers spoke with a witness, who stated that a white male subject with jean shorts and no shirt had opened the garage door and had entered the garage. The witness stated that upon questioning the suspect about being inside the garage, the suspect fled north on Cherry Alley.

Police said a Clayton Police officer witnessed the suspect walking out from behind a residence located farther north on Cherry Alley, the officer was able to take the suspect into custody without incident.

The suspect was identified as Thomas Warner, 40, of the 100 block of Cherry Alley in Clayton. Warner was arrested for third degree burglary and criminal mischief. Warner was arraigned in Justice of the Peace Court 2 and was released on an unsecured bond.
