A 14-year-old male from Clayton has been accused of raping an 8-year-old boy on three separate occasions.

There are two cases pending against the teen, who attended eighth grade at Smyrna Middle School last year.

In the first case, he is charged with one count of rape and one count of unlawful sexual conduct at his home. The second case, involving two counts of rape and one count of unlawful sexual contact, stems from two reported incidents at a home in Cheswold.

The teen has been accused of forcing the 8-year-old to perform oral sex on three separate occasions, according to court documents. After the third incident, the victim told his mother, court documents said.

The victim also told police that after the 14-year-old was confronted by the victim’s mother, the teen held a knife to his own neck told the victim to “tell the truth or I will kill myself.”

Cheswold Police arrested the Clayton teen July 18. He was committed to New Castle County Detention Center in Wilmington on a $17,000 secured bond, according to Corporal Susan Kline of the Cheswold Police.

Although he could not comment on the specific case, Smyrna School District Assistant Superintendent Buddy Lloyd said when a student is charged with a crime of this nature, “the person would be not allowed to attend until more details are discovered.”

“Once we are aware that charges are filed against someone and the charges indicate they are a threat to other students’ safety or well-being we try to err on the side of safety of the students,” Lloyd said. “When a child poses a threat to the welfare and safety of other students, we look to try to find an alternative placement for them. Depending on the nature of the offense, the child could be expelled and not offered services also.”
