Smyrna contractor awaits indictment in Camden embezzlement case

Former Camden Town Manager James O. Plumley III and Smyrna contractor Mark A. Moore both await indictments to be handed down by state prosecutors with regard to allegedly embezzling $120,000 from the town of Camden.

But, it is not clear when those indictments will be handed down by prosecutors from the state Office of the Attorney General. This office handles all prosecutions in the state of Delaware.

“We don't comment on timeframes for bringing cases before the grand jury for indictment,” Delaware Department of Justice spokesman Jason P. Miller said Tuesday. “The case is in Superior Court and indictment is the next step.”

Both men waived their rights to preliminary hearings back on Feb. 3, and both of their cases were accepted by Delaware Superior Court on Feb. 7, according to the Office of the Prothonotary at the Kent County Courthouse in Dover.

Camden Police said Plumley embezzled money from the town by writing up false invoices for repairs that never took place. He enlisted the aid of Moore, principal of Building Exterior Services LLC, where Plumley was registered as an agent.
